Dr. McCracken’s book is partly historical and partly analytical. It opens with as good a summary of Irish history from the founding of the Gaelic League in 1893 until the general election of 1918 as one could wish for. The resounding victory won by Sinn Féin in 1918 prepared the way for the first and second Dáil, whose membership is here analysed from the standpoints of age, religion, education and occupation with some interesting results. New technologies allow owners to extendtheir control of both legitimate uses and misuses ofthe intellectual property. Recent trends demonstratethat the access principle has not always beenparamount in judicial or legislative applications. Thetrend rather is to allow a proprietarianism factor todominate the analysis. Finally, several principles areforwarded which would assist adjudicators and policymakers in reaffirming the basic purpose of theintellectual property law, which is to benefit thepublic at large. This article explores recent developments inthe regulation of Internet speech, inparticular, injurious or defamatory speech andthe impact the attempts at regulation arehaving on the `body' in the sense of theindividual person who speaks through the mediumof the Internet and upon those harmed by thatspeech. The article proceeds in threesections. First, a brief history of the legalattempts to regulate defamatory Internet speechin the United States is presented; a shortcomparative discussion of defamation law in theUK and Australia is included. As discussedbelow, this (...) regulation has altered thetraditional legal paradigm of responsibilityand, as a result, creates potential problems forthe future of unrestricted and even anonymousspeech on the Internet. Second, an ethicalassessment is made of the defamatory speechenvironment in order to determine which actorshave moral responsibility for the harm causedby defamatory speech. This moral assessment iscompared to the developing and anticipatedlegal paradigm to identify possible conformityof moral and legal tenants or to recognize theconflict between morality and law in assigningresponsibility to defamatory actors. Thisassessment then concludes with possiblesuggestions for changes in the legal climategoverning the regulation of defamatory speechon the Internet, as well as prediction of theresult should the legal climate continue todevelop on its present course. This is not tosuggest that all law, or even the law ofdefamation, be structured to reflect thesubjectivity of a moral construct, but since itis the authors position that the legalassignment of liability in online settings ismisaligned, this reflection can serve asbeginning reassessment of that assignment. As the National Information Infra- structure develops new avenues for information products and services will open. Creating, identifying and protecting the information market space is a critical component to the success of information product and service developments. As a result, the producers of those products and service seek to protect their proprietary interest in the underlying information. However, these actions have broader consequences: Attempts to extend legal protection to basic facts and other public domain information demonstrate that the public information (...) space is slowly being reduced. Reviewing several information controversies as case studies is fruitful. Not only for assessing current trends in information disputes (warfare) but can form the basis for establishing several predictors useful in determining when future information ownership controversies may develop and result in the loss of public information space. One set of predictors helps define the information controversy and is descriptive. The second set of predictors characterizes the marketplace environment. It provides further nuance to the economic factors that force information owners to seek legal remedy. Identifying instances where both models suggest a change in information rights or ownership is most likely to result in the critical loss of access to public information space. (shrink)

We present a theoretical view of the cellular foundations for network-level processes involved in producing our conscious experience. Inputs to apical synapses in layer 1 of a large subset of neocortical cells are summed at an integration zone near the top of their apical trunk. These inputs come from diverse sources and provide a context within which the transmission of information abstracted from sensory input to their basal and perisomatic synapses can be amplified when relevant. We argue that apical amplification (...) enables conscious perceptual experience and makes it more flexible, and thus more adaptive, by being sensitive to context. Apical amplification provides a possible mechanism for recurrent processing theory that avoids strong loops. It makes the broadcasting hypothesized by global neuronal workspace theories feasible while preserving the distinct contributions of the individual cells receiving the broadcast. It also provides mechanisms that contribute to the holistic aspects of integrated information theory. As apical amplification is highly dependent on cholinergic, aminergic, and other neuromodulators, it relates the specific contents of conscious experience to global mental states and to fluctuations in arousal when awake. We conclude that apical dendrites provide a cellular mechanism for the context-sensitive selective amplification that is a cardinal prerequisite of conscious perception. (shrink)

An experimental, conceptually driven foray into the Patrician field, Ireland’s ubiquitous national apostle – a former captive – is utilised as a vehicle through which to explore a trinity of salient and interrelated themes within the Catholic and Protestant hinterlands of the Irish imagination: visions of imprisonment; of the island; and of imperialism. The reader is guided through aspects of Patrician literature, visits the island’s hallowed Patrician shrines, and is thus shown Purgatory. Insights into the imaginations exhibited by a range (...) of influential Irish ideologues and intellectuals – Gerry Adams; J.B. Bury; John Hume; Eóin MacNeill; Michael McCarthy; John Mitchel; Peadar O’Donnell; Tomás Ó Fiaich; John Ryan; William Ryan; Ian Paisley; Patrick Pearse; Oscar Wilde – are generated. The cognitive (and conspicuously Platonic) terraforming of the prison-cell into an island, and of the island into a giant prison – of either British or Vatican construction – that recurs in much Irish political thought and reflection, is observed. The concluding section involves historiographical reflection: Bury’s, and by extension St. Patrick’s, influence with regards the development of the discipline of Irish history is highlighted. That the island exhibits a distinctive intellectual micro-climate, one in which visions of Patrick act as a formidable ideological force, is implicit throughout. (shrink)

Nursing is possible owing to a series of intricate systemic relations. Building on an established tradition of sociological research, we critically analysed the nursing profession in Chile, with an emphasis on its education system, in the light of social systems theory. The paper's aim was to explore basic characteristics of nursing education as a system, so as to outline its current evolution. Drawing on recent developments in nursing, we applied an empirical framework to identify and discuss functionally differentiated systems that (...) are relevant to nursing and observe communications between them. We found that the dynamics of nursing as a whole develop from communications with closely related systems, including the nursing profession and the education system more broadly. While the discipline (as a system of representations) strives to control the profession (as an applied occupational field), the necessities of practicing nurses imply other forces mediating the making of the profession, a process framed by market dynamics in education and health. Critical congenital heart disease screening is rapidly becoming the standard of care in the United States after being added to the Recommended Uniform Screening Panel in 2011. Newborn screens typically do not require affirmative parental consent. In fact, most states allow parents to exempt their baby from receiving the required screen on the basis of religious or personally held beliefs. There are many ethical considerations implicated with allowing parents to exempt their child from newborn screening for CCHD. Considerations include the (...) treatment of religious exemptions in our current legal system, as well as medical and ethical principles in relation to the rights of infants. Although there are significant benefits to screening newborns for CCHD, when a parent refuses for religious or personal beliefs, in the case of CCHD screening, the parental decision should stand. This article presents Gilbert Simondon as a philosopher of (technological) mediation. An attempt is made to combine and present Simondon’s multifaceted and often sporadic perspectives on the subject of (technological) mediation. At the same time, it is attempted to contextualize Simondon’s thought in light of other authors and philosophical theories to show its relevance and similarities. First of all, the relevance of Simondonian ontogenetic account of mediation to contemporary philosophy of mediation is shown. Secondly, Simondonian critique of the conceptual structure (...) of hylomorphism, understood through the lens of mediation, is compared with the Heideggerian one. Both interpretations are understood through Verbeek’s suggestion to ruminate on how technologies mediate our grasp of metaphysics. Lastly, political and scientific aspects of the Simondonian concept of mediation are discussed. In between, Simondon’s general ambivalent position on the progress of technology is shown. (shrink)

Some philosophers believe that when epistemic peers disagree, each has an obligation to accord the other's assessment the same weight as her own. I first make the antecedent of this Equal-Weight View more precise, and then I motivate the View by describing cases in which it gives the intuitively correct verdict. Next I introduce some apparent counterexamples – cases of apparent peer disagreement in which, intuitively, one should not give equal weight to the other party's assessment. To defuse these apparent (...) counterexamples, an advocate of the View might try to explain how they are not genuine cases of peer disagreement. I examine David Christensen's and Adam Elga's explanations and find them wanting. I then offer a novel explanation, which turns on a distinction between knowledge from reports and knowledge from direct acquaintance. Finally, I extend my explanation to provide a handy and satisfying response to the charge of self-defeat. (shrink)

This work presents a causal conception of metaphysical modality in which a state of affairs is metaphysically possible if and only if it can be caused (in the past, the present or the future) by current entities. The conception is contrasted with what is called the "combinatorial" conception of modality, in which everything can coexist with anything else. This work explains how the notion of 'causality' should be construed in the causal theory, what difference exists between modalities thus defined from (...) nomological modality, how accessibility relations between possible worlds should be interpreted, and what is the relation between the causal conception and the necessity of origin. The present article revolves around the notion of universality and its relation to freedom and temporal orientation in contemporary political thought, with a focus on Susan Buck-Morss' notion of universality. The purpose is twofold. Firstly, I discern and critique the historico-political premises of her approach. Secondly, I suggest an alternative historico-political approach to universality addressing the drawbacks of her approach. I present three objections to her approach. Drawing on Arendt's distinction between liberation and the practice of freedom, I first present (...) a critique of the conceptualisation of freedom on which Buck-Morss' approach hinges, arguing that she overemphasises the moment of liberation. Thereafter, I turn to her reflections on historical orientation. My third objection concentrates on Buck-Morss' concept of universality. As a heuristic tool to expound on my critique, I activate the distinction between fictive and ideal universality as suggested by Étienne Balibar. I contend that Arendt's distinction between liberation and the practice of freedom efficiently elucidates the questions at stake in Balibar's discussion, as well as how his distinction points to the limits of Buck-Morss' argumentation. Ultimately, I contend that these critical remarks open up for a more dialectical approach to universality as a historical-political problem. (shrink)

During the mid-nineteenth century, the shifting boundaries of natural history and hunting practices were at the core of debates about general and practical knowledge, science and leisure, hunters and poachers. Focusing on the Swiss naturalist Johann Jakob von Tschudi and his travels to South America, this article reexamines the relationships of natural history and hunting skills in forging a kind of scientific “hegemonic” masculinity. For this purpose, it reconstructs Tschudi’s social formation in bourgeois circles during the institutionalization of natural history (...) in Switzerland. More than his natural history knowledge, Tschudi’s hunting skills were crucial for the success of his Peruvian expedition (1838–1842), and thus his zoological treatise Fauna peruana could be considered a manual for hunting in the Amazonian rainforest and the Andes. Finally, this article analyzes the class and race intersections of Tschudi’s scientific discourse about poachers in the German states and in the Brazilian empire. The study of Tschudi’s biography, especially his roles as a global naturalist and a “true hunter,” sheds light on natural history as a space for constructing class, gender, and race hierarchies during the mid-nineteenth century, in both South American and German-speaking contexts. MV-algebras stand for the many-valued Łukasiewicz logic the same as Boolean algebras for the classical logic. States on MV-algebras were first mentioned [20] in probability theory and later also introduced in effort to capture a notion of `an average truth-value of proposition' [15] in Łukasiewicz many-valued logic. In the presented paper, an integral representation theorem for finitely-additive states on semisimple MV-algebra will be proven. Further, we shall prove extension theorems concerning states defined on sub-MV-algebras and normal partitions of unity generalizing (...) in this way the well-known Horn-Tarski theorem for Boolean algebras. Máme tři hlavní teorie blahobytu. První je hédonismus. To je teze, že blahobyt jednotlivce zcela závisí na tom, jak se cítí. Blahobyt prostě spočívá v potěšení. Je pro něj dobré, aby prožíval příjemné zážitky ve svém životě. A špatné je pro něj, aby ve svém životě trpěl. Nejlepší život je pak takový, který znamená největší možnou převahu potěšení nad bolestí. Druhá je teorie touhy, která znamená, že něco je pro někoho dobré, protože to splňuje jeho touhu. Je na tom lépe (...) do té míry, do jaké dostane to, co chce. Stručně, blahobyt spočívá v realizaci subjektivních preferencí. Třetí teorie blahobytu je perfekcionismus. To je názor, že dobrý je rozvoj určitých schopností, které jsou charakteristické pro člověka. Tyto schopnosti zahrnují zejména naši racionalitu, teoretickou i praktickou. Blahobyt spočívá v sebe-zdokonalování, v životě excelentní a ctnostné aktivity, resp. v dobrém fungování lidské bytosti. Počiny, jako jsou úspěšné projekty, poznání, estetická zkušenost, rodičovství a přátelství, jsou konstitutivní pro naši lidskou prosperitu. V tomto článku dospívám k závěru, že tyto tři konkurenční teorie ztělesňují odlišné koncepce autenticity. (shrink)

Networked service organisations are increasingly adopting a ‘smarter networking’ philosophy in their design of more agile and customer-focused supply models. Changing consumer behaviours and the emergence of transformative technologies—industry 4.0, artificial intelligence, big data analytics, the Internet of Things—are driving a series of innovations, in terms of ‘products’ and business models, with major implications for the industrial enterprise, in their design of more ‘digitalised’ supply chains. For B2B systems, emerging ‘product-service’ offerings are requiring greater visibility, alignment and integration across an (...) increasingly complex network of multiple partners and collaborators, in order to deliver a better service and customer ‘experience’. To support the design and operation of these multi-organisational service networks, we outline a concept of operations architecture here, underpinned by the literature and network theory, and demonstrate application using a series of exemplar case studies. Focusing on relational elements and the processes key to network integration within service supply networks, the cases inform a set of operating principles and protocols—applicable to all stakeholders ‘cooperating’, within a ‘shared’ environment. Equally critical is to understand how digital technologies may influence future operating philosophies. This article extends our theoretical understanding of network organisations, from a traditional ‘product’ perspective to that of ‘services’, and presents the case for developing a common, unified approach to designing diverse forms of multi-partner service networks. This article explores the philosophy of Alain Badiou from the vantage point of the concepts of the localization, delocalization, and relocalization of the void as thematized through literary arts, religion, emancipatory politics, and the subject of psychoanalysis. In short, these moments around the void characterize the processes through which truth is processed and seen through their full realization by a philosophical engagement across the various conditions in which these truths occur. The localization of a void is the naming of an (...) indiscernible element that is incommensurable to the rubric of constructible knowledge, sense and meaning which could saturate the space of truth. Thus, the naming that localizes the void acts as a subtraction of the invariant in the variance of situation such that across various points in space and time, we are still able to subtract the universal as the invariant not just as the fidelity to the localized truth but also as the resurrection of truth upon its relocalization at a different place and a different time. At its core, this article is concerned with truth, why truth is persistent, and why we have to struggle to articulate the truth that we are trying to be faithful to again and again with each instance that truth risks being covered-over and obscured. Este artículo explora el concepto de trauma colectivo y su aplicación en el contexto histórico y social de las sociedades latinoamericanas. La transferencia del término «trauma colectivo» desde el campo del conocimiento psicológico a la esfera social e histórica plantea preguntas sobre su legitimidad y marco conceptual. El estudio examina la fidelidad de esta transferencia conceptual y su relación con la comprensión psicoanalítica temprana de los fenómenos traumáticos. El contexto cultural europeo de finales del siglo xix y principios del siglo (...) xx proporcionó la base para teorizar las consecuencias de experiencias intensas y violentas, lo que resultó en el concepto de «neurosis traumática», influenciado significativamente por el trabajo de Freud. El artículo discute la apropiación de herramientas psicoanalíticas en la crítica histórica y cultural para comprender eventos que desafían marcos tradicionales y la inteligibilidad social, como el Holocausto. La noción del trauma como una fuerza enigmática y recurrente en la experiencia histórica se explora a través del enfoque de los estudios del trauma. El artículo pone de relieve a destacados y destacadas académicas en este campo y su uso de conceptos psicoanalíticos, demostrando la preservación y aplicación significativa de estas nociones en la comprensión de fenómenos históricos y colectivos. Al acortar la brecha entre las experiencias psicológicas individuales y los traumas colectivos, los estudios del trauma ofrecen un enfoque único para interpretar y representar eventos que resisten las narrativas históricas tradicionales. The conception of the unconditional, irreducible, and irreversible asymmetry of the relationship between I and the Other is one of the crucial issues of Levinas’s ethical metaphysics. Since it is precisely in the name of the asymmetry that reciprocity as an ethics-founding principle is excluded from Levinas’s conceptual framework , many scholars have judged his ethics as unfeasible. This article aims to examine the key points of the debate about the Levinasian conception of asymmetry, to go, eventually, beyond Levinas, in (...) an attempt to re-address the following questions: Is there a “transcendental symmetry” as a basis of the ethical asymmetry? Can we reconcile asymmetry and reciprocity? Does the requirement of mutual recognition touch the Other’s asymmetrical transcendence, as Ricoeur suggests? Finally, the article presents a conception of “asymmetrical reciprocity” that focuses notably on the reality of friendship and of gift, a conception seen as the basis of the relationship characterized by gratitude, generosity, and desire for communion. This article presents an analysis of how a male convert to Islam incorporates events from his life history into a narrative structure in order to construct and maintain a Muslim identity. The study focuses on how the individual and in particular a person's life history becomes social and universal, and how the social and universal becomes particularized and individualized, in the narration of life. The results of the analysis showed that the valued endpoint determines the selection and ordering of different (...) episodes, and the causal connections that are made between them. Many episodes in this convert's life story is similar to other converts' narratives, for example, descriptions of absent significant others during childhood, an inclusion of a Christian phase in life, and the importance attributed to the Qur'an in the process of conversion. The incorporation of these episodes in one's life story and the way the narratives are structured are interpreted as influences from collective narratives. Moreover, the analysis revealed that the selected episodes have important social, individualizing and sedative functions in the flux of discourses in postmodern society. Thus, the individual's Muslim identity is an amalgamation of the particular and the universal and the importance of the narratives lies in the fact that they can integrate particular experiences into a universal structure that gives them a meaning. En el presente documento se abordan algunas de las contribuciones más recientes al debate filosófico en implicancia con las modificaciones de la clínica psicoanalítica actual. Nuestro objetivo fue mediante un análisis documental con miramiento teóricocrítico contribuir al esclarecimiento de las herramientas fundamentales que la filosofía entrega a la modificación de la teoría y práctica psicoanalítica. (...) Para tal efecto, hemos trazado un recorrido histórico general a las modificaciones y argumentos que a lo largo de la historia del psicoanálisis hanido emergiendo. Finalmente, exponemos algunos de los debates y tesis pendientes de continuar explorando, en miras de la mixtura de los saberes y en beneficio de las reflexiones y análisis enfocados en la condición humana, cuestiones que tanto la filosofía como el psicoanálisis tienen como ejes centrales. The multitude of training models and curricula for the specialty of clinical neuropsychology around the world has led to organized activities to develop a framework of core competencies to ensure sufficient expertise among entry-level professionals in the field. The Standing Committee on Clinical Neuropsychology of the European Federation of Psychologists’ Associations is currently working toward developing a specialty certification in clinical neuropsychology to establish a cross-national standard against which to measure levels of equivalency and uniformity in competence and service provision (...) among professionals in the field. Through structured interviews with experts from 28 European countries, we explored potential areas of core competency. Specifically, questions pertained to the perceived importance of a series of foundational, functional, and other competencies, as well as current training standards and practices, and optimal standards. Our findings revealed considerable agreement on academic and clinical training, despite varied actual training requirements currently, with fewer respondents relegating importance to training in teaching, supervision, and research, and even fewer to skills related to management, administration, and advocacy. European expert clinical neuropsychologists were in agreement with previous studies regarding the importance of sound theoretical and clinical training but management, administrative, and advocacy skills were not central to their perspective of a competent specialist in clinical neuropsychology. Establishing a specialty certificate in clinical neuropsychology based on core competencies may enable mobility of clinical neuropsychologists across Europe, and, perhaps, provide an impetus for countries with limited criteria to reconsider their training requirements and harmonize their standards with others. Esta perspectiva ilumina ámbitos tan diversos como el carácter transnacional de las relaciones y organizaciones, el papel de la localidad en la explicación del hecho migratorio, la ciudadanía y el emprendimiento y, en general, la movilidad de ideas, habilidades, conceptos y recursos. Para la realización del estudio se recurre a numerosas entrevistas y encuentros realizados en Tenerife y Madrid que dan cuenta del periplo migratorio de muchos emigrantes que, además, en las dos últimas décadas han regresado de manera masiva a Canarias dada la situación que conoce Venezuela. This study was designed to survey the extent to which private companies in Sweden take structural measures within the field of business ethics: Codes of Ethics; Ethics Committees; Ethics Officers and Ethics Training. This was done in two steps. Through a nation-wide telephone survey, a population of "active" companies were identified. These companies received a questionnaire with detailed questions regarding the design, usage and effects of these measures. The percentage of active companies were found to be a high 46%. This article discusses the problematic aspects relating to the employee dismissal based on application of the disciplinary liability. It contains analysis of two grounds for termination of the employment contract without any previous notice: 1) imposing several disciplinary sanctions upon the employee in the course of twelve months, and 2) the employee has only one breach of labour discipline but a gross one. The article is based on legal acts and judgements of Judicial Assemblies of the Civil Division of the (...) Supreme Court of Lithuania and resolutions of the Senate of the Supreme Court of Lithuania in order to provide the legislative execution practice as well as reveal the problems in this field of labour law. The aim of the paper is twofold. First, it expounds the thesis of ‘conceptual relativity’ propounded in a series of writings of the well-known philosopher Hilary Putnam and indicates the alleged manner in which the thesis, according to Putnam, undermines the foundations of metaphysical realism (understood in a peculiar way spelled out in the paper). Second, a critical examination of Putnam’s anti-metaphysical-realist argument is offered. It is argued that Putnam offers examples only of a trivial, so-called indexical relativity, and that (...) his strategy leaves the foundations of metaphysical realism intact. (shrink)
